If you are planning to build on your lot there are certain procedures that you must follow to be in compliance with the Protective Covenants.  All building plans must be submitted to the Architectural Control Committee for review and approval PRIOR to any excavation, tree removal, or commencement of building.

These plans and specifications include the floor plan, elevations, plot plan, grading and landscaping plans, principal exterior materials, color schemes and the locations, character, and method or utilization of all utilities.  Each building shall be constructed in accordance with these plans and specifications.   

All dwellings must be of the type that is constructed “on-site”.  Travel homes, mobile homes or homes that are pre-fabricated off site and moved in for erection will not be allowed in this subdivision.  There are minimum floor area and valuation requirements.  In reviewing the building plans the Committee will also take into consideration the suitability of the design and materials, and the harmony on the view from adjacent or neighboring lots.

Please also review the Protective Covenants for other requirements.  Note that home-based businesses must be approved in advance by the Architectural Control Committee.  Businesses that solicit on-site public will NOT be approved.   The Board of Directors is obligated to seek compliance by all lot owners with the Protective Covenants. If you are considering purchasing a lot within Spread Eagle, now is the time to review this document.

Additional Notes:

All structures must comply with the Colorado Plumbing and Electrical codes, and all requirements of Custer County, including lot setback.   Please contact Custer County Zoning Department at 719.783.2669 for additional information.

Each individual home owner is responsible for the construction, maintenance and repair of individual water lines from the Association main valve into the individual home.  All individual water lines from the Association main valve to the individual home must be of K-type 1" copper encased within a 3" or 4" minimum Schedule 40 PVC sleeve.  These requirements are to minimize the risk of water line breakage due to freezing/thawing of the ground, thereby draining the entire community water system.
